PLEASE READ THE TERMS OF USE BEFORE USING AND ACCESSING THE SITE AND THE SHOP. (Last Updated 05.28.2021)
THE FLAUNT IT COLLECTION website located at http://www.flauntit.ca/ is a copyrighted site belonging to THE FLAUNT IT MOVEMENT. The Site is owned and operated by the Flaunt It Movement via. the e-commerce platform Shopify. Certain features of the Site and the Store may be subject to additional guidelines, terms, or rules, which will be posted on the Site and Shop in connection with such features.
All such additional terms, guidelines, and rules are incorporated by reference into these Terms.
These Terms of Use describe the legally binding terms and conditions that oversee your use of the Site. BY LOGGING INTO THE SITE, YOU ARE IN COMPLIANCE WITH THESE TERMS. Further, that you have the authority and capacity to enter these Terms. You must be 18 years or older, or at least the age of majority in the jurisdiction where you reside or from where you order to access this site. IF YOU DISAGREE WITH ALL OF THE PROVISION OF THESE TERMS, DO NOT LOG INTO AND/OR USE THE SITE. Flaunt It Movement reserves the right to terminate access to the Store and Site for any breach of the Terms of Use.
Access to the Site:
Flaunt It Movement grants you a non-transferable, non-exclusive, revocable, limited license to access the Site and the Shop solely for your own personal, noncommercial use.
Propriety Rights:
The rights approved to you in these Terms are subject to the following restrictions:
- you shall not resell, transfer, assign, distribute, host, or otherwise commercially exploit the Site or the products of the Shop
- you shall not change, make derivative works of, disassemble, reverse compile or reverse engineer any part of the Site and the Shop
- no part of the Site and the Shop may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means unless otherwise indicated, any future release, update, or other addition to functionality of the Site shall be subject to these Terms. All copyright and other proprietary notices on the Site must be retained on all copies thereof. All of the Contents are the property of Flaunt It or their respective owners, and nothing on this Site shall be construed as granting any license or right to use the Contents without licensors’ prior written consent.
Flaunt It reserves the right to change, suspend, or cease the Site with or without notice to you. You approved that Flaunt It will not be held liable to you or any third-party for any change, interruption, or termination of the Site and Store or any part.
Indemnity
You agree to defend, indemnify, and hold Flaunt It’s team against all damages, claims, liabilities, settlements, losses, and cost and expenses as a result of your use of the Site, Store, or your violation of these Terms of Use.
You hereby release and forever discharge the Flaunt It Movement, and hereby waive and relinquish, each and every past, present and future dispute, claim, controversy, demand, right, obligation, liability, action and cause of action of every kind and nature, that has arisen or arises directly or indirectly out of, or that relates directly or indirectly to, the Site and the Shop.
Product Pricing, Disclaimer and Limitation of Liability
Flaunt It has displayed their products as accurately as possible. Products may be out of stock, discontinued, or subject to change. While Flaunt It strives for accuracy in product description, inventory, and availability, Flaunt It does not warrant accuracy, reliability, or currency of such description. Products displayed on Flaunt Its website are subject to change.
You agree to use the Site according to its availability. Flaunt It cannot guarantee that the site will be error free, or that the Site or use of Shopify’s products is free of viruses. The site is provided on an "as-is" and "as available" basis, and company and our suppliers expressly disclaim any and all warranties and conditions of any kind, whether express, implied, or statutory, including all warranties or conditions of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, or non-infringement. We and our suppliers make not guarantee that the site will meet your requirements, will be available on an uninterrupted, timely, secure, or error-free basis, or will be accurate, reliable, free of viruses or other harmful code, complete, legal, or safe.
Flaunt It is only liable for direct damages and is not, under any circumstance, liable for indirect or punitive damages whether arising in tort, contract, breach of statutory duty, or otherwise.
To the maximum extent permitted by law, in no event shall Flaunt It or our suppliers be liable to you or any third-party for any lost profits, lost data, costs of procurement of substitute products, or any indirect, consequential, exemplary, incidental, special or punitive damages arising from or relating to these terms or your use of, or incapability to use the site even if company has been advised of the possibility of such damages. Access to and use of the site is at your own discretion and risk, and you will be solely responsible for any damage to your device or computer system, or loss of data resulting therefrom.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Terms and Conditions of Purchase and Sale
Order Confirmation
Once an order has been placed and confirmed on www.flauntit.ca, it cannot be cancelled. Once it has been received, it can be returned only if the item is eligible for a return in accordance with our Return Policy.
Flaunt It reserves the right to cancel any orders placed and limit or cancel quantities purchased per person and household. These restrictions include orders placed with the same account, credit card, and/or orders using the same billing and shipping address. Flaunt It reserves the right to prohibit orders that, under our discretion, are placed by dealers, resellers, or distributors.
If an order is cancelled, Flaunt It will contact you via email, billing address, or phone number.
CANADIAN AND INTERNATIONAL SALES
The Flaunt It Collection sells and ships its merchandise ordered through this Site internationally. We will only ship to a valid address.
We reserve the right to refuse an order if the particulars of the order and payment requirements do not satisfy our purchase and delivery conditions.
PRICE, PAYMENT AND SHIPPING PRICE
All prices quoted are payable in Canadian Dollars. Taxes and shipping are extra depending on the delivery address and are displayed during check-out and in the Order Confirmation. Although The Flaunt It Collection strives to provide accurate product and pricing information, errors may occur. The Flaunt It Collection reserves the right to correct any errors in pricing or product information and to modify the prices of Products, at any time, without prior notice. The Flaunt It Collection cannot confirm the price of a Product until after you submit an order for the Product. Without limiting the generality of the provisions above, in the event that the price or related information for a Product (as described on the Site and/or the Order Confirmation) is incorrect due to an error in pricing or product information, The Flaunt It Collection may, at its sole discretion, refuse or cancel your order, whether before or after The Flaunt It Collection’s acceptance thereof. If there is such an error in pricing, The Flaunt It Collection will cancel your order and reverse any charges that have been applied, then contact you to ask you to place a new order for the Product at the correct price.
Payment Method
The Flaunt It Collection accepts American Express, MasterCard, Visa, PayPal, ApplePay and Amazon Pay for payment of purchases made through this Site. The Flaunt It Collection also accepts electronic transfers to the email: info@flauntit.ca only for residents of Ontario. The cardholder must be the person who places the order.
When we receive your order, we will verify your billing address to ensure that it matches the address which you have provided to us. The Flaunt It Collection does not retain your credit card number following authorization by the financial institution issuing the credit card.
Credit Card Security
We value your security and privacy with all online transactions. We use Secure Sockets Layer (“SSL”) technology to protect the security of your credit card information as it is transmitted to us.
SSL is the industry standard for secure commerce transactions. It prevents your personal information from being read by someone else as it travels across the Internet. All of your personal information is encrypted, including credit card number, name and address. Nevertheless, there are certain risks associated with using the Internet. Please see the disclaimer below. Additionally, while we implement the above security measures on this site, you should be aware that 100% security is not always possible.
Shipping and Pickup Terms in Canada
The Flaunt It Collection ships to any Canada Post mailbox within Canada. Curbside pickup is available under the following conditions:
- The customer has placed and paid for an order through flauntit.ca OR e-transferred community@flauntit.ca
- The customer has selected ‘pick-up’ as the option during checkout and receives the order confirmation & subsequent email stating the order is ready for pickup OR the customer has made a verbal or written contract with Sariena Luy to pick up the merchandise, agreeing on a date and time
- The customer is in North York, Ontario on the agreed pick-up date and time
For pick-up orders only, no shipping fees will be charged. Failure to pick-up an order in-person will result in termination of the order after 30 days of the purchaser’s inability to communicate alternative delivery methods with us. The Flaunt It Collection reserves the right to cancel a pickup order due to failure to pick up on an agreed time or date, failure to adhere to Ontario social distancing and curbside pickup regulations, or the aforementioned. If the purchaser is unable to meet at the scheduled pick-up time and date, arrangements can be made with Sariena Luy to reschedule to pick up date OR ship the merchandise instead, whereby the purchaser will be charged appropriate shipping fees. If unable to obtain your product via. curbside pickup despite choosing this delivery option at checkout, please email admin@flauntit.ca immediately to discuss alternative delivery methods.
The Flaunt It Collection ships with Canada Post Standard, Priority or Expedited Shipping services. The preferred speed of service can be chosen at checkout and the associated speed and price will be displayed in your shopping cart prior to purchase. The Flaunt It Collection is not responsible for merchandise damages incurred during shipping. The Flaunt It Collection reserves the right to deny exchanges and returns for merchandise damaged as a result of shipping.
Return & Exchange Policy
We do not accept returns or exchanges unless the item you purchased is defective. If you receive a defective item, please contact us at admin@flauntit.ca with details of the product and the defect.
If Flaunt-It's team agrees to take a defective item, then an mailing address will be provided. The customer will have to ship the item at their expense. Upon receipt of the returned product, we will fully examine it and notify you via e-mail, within a reasonable period of time, whether you are entitled to a refund or a replacement as a result of the defect. If you are entitled to a replacement or refund, we will replace the product or refund the purchase price, using the original method of payment.
Security and Privacy
Violating Flaunt Its system or network security is subject to civil and/or criminal liability. The personal information you submit to Flaunt It on the Site is governed and protected and Flaunt Its Privacy Policy
Electronic Communications.
The communications between you and Flaunt It use electronic means, whether you use the Site, the Shop, contact us through social media, or send us emails. For contractual purposes, you consent to receive communications from Company in an electronic form agree that all terms and conditions, agreements, notices, disclosures, and other communications that Company provides to you electronically satisfy any legal obligation that such communications would satisfy if it were in a hard copy writing.
Third-Party Links & Ads.
The Site and Shop may contain links to third-party websites and services, and/or display advertisements for third-parties. Such Third-Party Links & Ads are not under the control of Flaunt It, and Flaunt It is not responsible for any Third-Party Links & Ads. Flaunt It provides access to these Third-Party Links & Ads only as a convenience to you, and does not review, approve, monitor, endorse, warrant, or make any representations with respect to Third-Party Links & Ads. You use all Third-Party Links & Ads at your own risk and should apply a suitable level of caution and discretion in doing so.
Cookies and Web Beacons.
Like any other website, Flaunt It Movement uses ‘cookies’. These cookies are used to store information including visitors’ preferences, and the pages on the website that the visitor accessed or visited. The information is used to optimize the users’ experience by customizing our web page content based on visitors’ browser type and/or other information. By accessing the Site and/or the Shop, you agree to use cookies in agreement with the Flaunt It Movement's Privacy Policy. Most interactive websites use cookies to let us retrieve the user’s details for each visit. Cookies are used by our website to enable the functionality of certain areas to make it easier for people visiting our website. Some of our affiliate/advertising partners may also use cookies.
Governing Law
These terms of Use will be governed by the laws of Ontario or Canada unless the applicable laws of the province of your residence require the laws of such province to govern.
Term and Termination. Subject to this Section, these Terms will remain in full force and effect while you use the Site and the Shop. We may suspend or terminate your rights to use the Site at any time for any reason at our sole discretion, including for any use of the Site in violation of these Terms. Upon termination of your rights under these Terms, your Account and right to access and use the Site will terminate immediately. You understand that any termination of your Account may involve deletion of your User Content associated with your Account from our live databases. Flaunt It will not have any liability whatsoever to you for any termination of your rights under these Terms.
General
These Terms are subject to occasional revision, and if Flaunt It makes any substantial changes, we may notify you by sending you an e-mail to the last e-mail address, billing address, and phone number you provided to us and/or by prominently posting notice of the changes on our Site. You are responsible for providing us with your most current e-mail address, phone number, and billing address. In the event that the last e-mail address, phone number, or billing address that you have provided us is not valid, our dispatch containing such notice will nonetheless constitute effective notice of the changes described in the notice. Any changes to these Terms will be effective upon the earliest of thirty (30) calendar days following our dispatch of an e-mail notice to you or thirty (30) calendar days following our posting of notice of the changes on our Site and Shop. These changes will be effective immediately for new users of our Site and Shop. Continued use of our Site and Shop following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
These Terms constitute the entire agreement between you and us regarding the use of the Site. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. These Terms, and your rights and obligations herein, may not be assigned, subcontracted, delegated, or otherwise transferred by you without Company’s prior written consent, and any attempted assignment, subcontract, delegation, or transfer in violation of the foregoing will be null and void. Flaunt It may freely assign these Terms. The terms and conditions set forth in these Terms shall be binding upon assignees.
